Ad Hoc Committee on Enforcement Report on the Meeting of October 12

 

Committee and Board:

 

The next meeting of the Ad Hoc com is October 26 at 10 a.m

 

Following is the report of the Ad Hoc Committee on Enforcement meeting of October 12.  Please address comments to all addressees.

 

1.  Complete the development of the FRCA Covenants and Enforcement Policy

 

The FRCA Covenants and Enforcement Policy was received from review by our lawyer Ed O'Connell.  Ed made only minor corrections to the draft submitted by the Board, and the Ad Hoc com agreed with the corrections.  Don will incorporate comments, as discussed by the Ad Hoc, and provide a draft to the Board for review and preliminary approval at the October 14 meeting.  At the next meeting, on October 28, the Board will be asked to approve, as final, the formatted resolution.  The resolution then will be printed and inserted in the November issue of the Gazette, with copies mailed to offsite owners.  An article will be placed in the December Gazette, and the Director's Corner and Insert will be coordinated with the announcement in the Gazette.

 

2.  Conduct and intensive review of the Design Guidelines and make required changes.

 

Discussion moved to October 26 meeting.  A suggestion was made by a resident to have a copy of the finalized Design Guidelines available in hard copy at the Center for comments by residents.  This will be included in the October 26 meeting agenda.

 

3.  Review and modify, as needed, the review processes for approval of Applications and Forms

 

Discussion moved to October 26 meeting.

 

4.  Review and modify, as needed, the inspections of FR residences.  Provide recommendations to the Board on:  (1) whether or not back yards should be inspected, (2) who should conduct the inspections and (3) how often the inspections should be conducted.

 

A recommendation was forwarded by the Ad Hoc Committee to the Board for the Modifications Committee to conduct inspections of Falls Run residences for a year, on a trial basis.  This recommendation supercedes the Ad Hoc Committee recommendation to the Board to have AMS do the inspections.

 

5.  Create and implement a plan to advertise the implementation of the FRCA Covenants and Enforcement Policy.

Recommendation of the Ad Hoc Committee on Enforcement Presented at the FRCABOD meeting on October 14

 

Board:

The following recommendation from the Ad Committee on Enforcement is revised and supercedes the recommendation forwarded October 12.

 

The Ad Hoc Committee recommends that the Modifications Committee conduct inspections of residences in Falls Run for a year, on a trial basis.  This recommendation supercedes the Ad Hoc Com September 11 recommendation forwarded to the Board to have AMS perform the inspections, and is based on a review by the Ad Hoc Com of the latest proposal inspections forwarded by the Mod Com.  The recommendation was opposed by Jake Bernard, who believes that all FR residences should be inspected fully, rather than the 10% proposed by Mod Com.  Jack Mounts and Tom Whalen expressed their views that the 10% was inadequate and should be 20 - 25%.

 

The Mod Com will conduct drive through inspections of all individual and villa homes twice a year.  If a possible violation is noted during the drive through, the property will be physically inspected in a walk around the entire property (front, sides and back).  The same standards will be used for both the front and back of the property.  A full inspection will be conducted of at least 10% of the total number of homes.  The percentage does not include resale inspections and inspections as a result of a modification request.  Home owners of residences to be inspected will be notified of the date of inspections.  Follow-up inspections will be conducted of those properties given violation notices. 

 

Additional inspectors will be recruited from residents, as needed.  Inspectors will be members of the Mod Com and report to the Chair.

 

A form will be available for residents to request an inspection of a neighbor's house.  The Ad Hoc Committee recommends that all forms, letters and any other materials to be distributed to residents be forwarded for approval by the Board.

 

The Mod Com members will uphold the FRCA enforcement resolution, will work closely with the Property Manager and Board, and may represent the FRCA in hearings and court proceedings.

1.  Complete the development of the FRCA Covenants and Enforcement Policy

 

The FRCA Covenants and Enforcement Policy was formatted by Tom and forwarded to the Board for final approval.  A question remains as to how the Resolution will be titled. 

 

The Ad Hoc Com is recommending that the resolution be distributed to the residents with a letter from President, the Board insert in the December issue of the Gazette be devoted to the resolution, and a presentation be given at a future Board meeting, probably in December, devoted to the Center Card system and the enforcement resolution.  Ann said the card system was announced in the insert in the October Gazette and an article has been written for the December Gazette.

 

2.  Conduct and intensive review of the Design Guidelines and make required changes.

 

This discussion was moved to the October 30 meeting. 

 

The Ad Hoc Com is forwarding to the Board the recommendation that the Board, upon receiving the final draft of the reworked Design Guidelines from the Modifications Committee and the Ad Hoc Committee on Enforcement, place the draft copy on the FR Website for comments, have a hard copy available for review and conduct a Board-sponsored town hall meeting. Suggestions relating to the guidelines received from the residents would be forwarded to the Mod Com for review and comment.

 

The Ad Hoc Com agreed that a request be made to residents for someone to retype/reformat the guidelines for the final version. If a volunteer is not found, a request would be made to the Board to authorize hiring a typist.

 

3.  Review and modify, as needed, the review processes for approval of Applications and Forms

 

Comments were forwarded on the modified applications for the single homes by Joan Bitely, and Paul Niemi presented his rewrite of the application form for the villas. The Ad Hoc discussed the issue of lack of coordination between the Mod Com/PM and the villas in the processing of requests approved by the Mod Com and forwarded for approval by the villa Board. 

 

Joan and Paul will rework the application forms to included suggested additions and will resubmit the forms to the Ad Hoc Com for comments and forwarding to the Board for approval.  Efforts will be made to have the new forms available to the residents as soon as possible.  Joan and Paul also said they would coordinate with the villas to develop a workable process for review/action on the villa modification requests.

 

 

 

4.  Review and modify, as needed, the inspections of FR residences.  Provide recommendations to the Board on:  (1) whether or not back yards should be inspected, (2) who should conduct the inspections and (3) how often the inspections should be conducted.

 

No effort on this step during this meeting. 

 

5.  Create and implement a plan to advertise the implementation of the FRCA Covenants and Enforcement Policy.

The FRCA Covenants and Enforcement Policy was formatted by Tom and approved by the Board during the meeting of October 28. 

 

2.  Conduct and intensive review of the Design Guidelines and make required changes.

 

The committee conducted an intensive review of the Design Guidelines, including changes made by the Modifications Committee and compiled by Betty Whitaker, during the 3-hour meeting.  The committee proceeded line by line through paragraph II, D.  Chuck Heath was asked to rewrite sections of the guidelines relating to landscaping.

 

3.  Review and modify, as needed, the review processes for approval of Applications and Forms

 

Application forms for the single family homes and villa homes were discussed and additional changes suggested.

 

4.  Review and modify, as needed, the inspections of FR residences.  Provide recommendations to the Board on:  (1) whether or not back yards should be inspected, (2) who should conduct the inspections and (3) how often the inspections should be conducted.

 

The committee reviewed the listing of work to be done, and the following additional items were proposed in support of the Mod Com conducting inspections:

 

a.  A "Board Violation Notice."  The notice would be completed by the inspector and signed by the Chair, Mod Com, and the Board President.   A copy of the notice would be accompany a standard violation letter to the resident.  This approach would provide the resident with details of the violation and official certification and would make it easier for automatic production of the standardized letter.

 

b.  A definitive "Procedures/Checkoff List" for conducting the inspections.  This will help ensure that all Mod Com inspectors will be using the same approved approaches when conducting the inspections. 

 

5.  Create and implement a plan to advertise the implementation of the FRCA Covenants and Enforcement Policy.

 

As a result of the committee meeting, October 26, the recommendation was forwarded to the Board for approaches to informing the residents of the enforcement policy.

The committee completed the intensive review of the copy of the Design Guidelines, including changes made by the Modifications Committee and compiled by Betty Whitaker. Betty volunteered to reformat the document and include all changes by the committee and mod com into a document (draft No. 2) to be reviewed by the Ad Hoc committee at their November 9 meeting.

 

The committee discussed and approved the following to be forwarded to the Board for discussion and possible motion at the November 10 Board meeting:

Notes of Ad Hoc Meeting on Enforcement - January 7, 2010

1.  Develop and implement FRCA Enforcement Policy and Procedures.

 

Done: 

 

1.  The FRCA Enforcement Policy and Procedures (Resolution 09-09) was completed and delivered to residents.

 

Meeting January 7:

 

o  Draft letters, as described in 09-09, were reviewed and modified, including the preliminary notice of  violation and results of the Covenants Committee and Board hearings.

 

o  A draft Notice of Violation and Opportunity to Appeal was reviewed and modified.  The Notice becomes the official tool of enforcement, providing the accused violator with specific information regarding the violation and hearings and documentations through all cycles of the violation.

 

o  A draft of the specific steps to be followed in the administration of the violation process was reviewed and modified.

 

Don Horan will redraft the letters and Violation Notice and Jack Mounts will redraft the procedures for implementing enforcement for review at the next meeting. 

 

3.  Review and modify, as needed, the review processes for approvals of Applications for Changes and Improvements and conducting inspections of FR residences.

 

Done:

 

1.  The Application for Changes and Improvements form for both single family homes and villa homes was redesigned from four pages plus an instruction sheet to a two-page form with two pages of instructions to make it easier to use by residents and reduce administrative processes.

 

Meeting January 7:

 

The Ad Hoc Committee asked the Modifications Committee to develop a management plan consisting of the following to support the FRCA inspections:

 

1.  Written plan on how Mod Com will do inspections, including who the inspectors will be, how they will be organized, and the general process they will use to conduct inspections.

 

2.  Written guidelines for the inspectors to ensure that the processes used by all inspectors will have a commonality of implementation (they will all do it the same way), including emphasis on inspectors gaining in-depth knowledge of the Design Guidelines, communications with residents, completing the Violation Notice, interfacing with the PM, and what to look for when inspecting the backyards, which have not been inspected for five years.

 

3.  Checklist for inspectors, including general categories of guideline areas (should these be completed for each household or should a general list be used for all).

 

4.  General notice to be provided to residents prior to inspections.

 

5.  Written description of how a program of drive through inspections could be conducted of FR residences to supplement the annual inspection, including recommended processes for conducting the inspections, when they would be conducted, and who would be doing them.

Notes of Ad Hoc Meeting on Enforcement - February 23, 2010

1.  The FRCA Enforcement Policy and Procedures (Resolution 09-09) was completed and delivered to residents.

 

Meeting February 23:

 

The redrafted letters/notices, as outlined in 09-09, and the Summary Sheet for AR 09-09 Action, both developed by Don, were reviewed by the Committee. The Summary Sheet provides instruction to the PM and documentation, step by step, through the entire enforcement process.  Minor corrections were noted. The committee approved the forms and Summary Sheet to be forwarded to Board for implementation. 

 

5.  Create and implement a plan to inform the Board and residents how the FRCA Enforcement policy will be implemented.

 

Meeting February 23:

 

The committee agreed to develop a plan to explain and advertise the implementation of the FRCA enforcement policy with respect to FRCA rules and regulations, including payment of assessments, the inspection of residences and the Community Center.  The Committee will give a presentation to the Board and residents, at the April 14 meeting, explaining how the enforcement policy came about, the need for it, and the process of development and approval by the Ad Hoc Committee, the Board and Legal.  An insert will be placed in the April Gazette providing an overview of the enforcement process and will be followed up with timed articles and inserts.

 

The one-page summary description of the enforcement process, developed by Jack, was approved with minor additions and will be included in the submission of the letters to the Board and will be used during the April presentation to the Board. Two meetings of the Ad Hoc Com will be held prior to April 14 to prepare for the presentation.

1.  Develop and implement FRCA Enforcement Policy and Procedures.

1.  The FRCA Enforcement Policy and Procedures (Resolution 09-09) was completed and delivered to residents.

 

Meeting March 1:

 

1.  Susan reported that, per discussions with Sandra Proffitt-Marsteller, AMS has agreed to incorporate the enforcement letters into Connect, allowing them to be run off and specific information added by Debbie and then automatically placed in FR resident files on Connect.  Sandra said that it will require significant effort to program the letters and create a FR template, but it should be done in a month or so.  Debbie said she will provide the Board with a list of residents who are currently behind at least 90 days in paying assessments.

 

2.  Debbie said she will use, as needed, outside resources to maintain an orderly and even workload and prevent backups which may occur because of the increased requirements of implementing the FRCA enforcement policy.  Funding for outside resources to support Debbie was placed in the 2010 budget, as a separate line item, by the Board.

 

3. The Committee is requesting that the Board of Directors obtain advice from legal regarding the type of processes to be used to enforce timely payment of resident assessments (i.e., whether or not the Board can remove privileges by notifying the resident by letter (which Susan Manch, AMS, says is done in other HOA's) or would FRCA be required to follow the processes of issuing violation notices, holding hearings, etc., as detailed in the procedures to implement AR 09-09 which were presented to the Board.  If FRCA is required to follow the violation notice procedures, more time will be required and more expenses incurred by the Association.

 

4.  Considerable discussion was held and issues raised regarding the implementation of enforcement in the Community Center.  Specific approaches to implementing the enforcement process are contained in the Community Center Rules and Regulations, which is currently being revised, and the detailed procedures developed to provide guidance for Concierges on enforcement.  It was noted that it would not be practical to set a limit on the number of times a person can forget their card before being refused entry into the Center; the concierge usually enters the data into the system manually when a resident forgets their card. 

 

4.  The Committee decided to await Board direction regarding the compilation of an "Issues Paper" to provide support to the Board in answering resident comments and questions relating to enforcement policy.

 

 

5.  Create and implement a plan to inform the Board and residents how the FRCA Enforcement policy will be implemented.

 

Meeting March 1:

 

The Committee decided that a written final summary report, rather than an oral presentation, to the Board would be better received and would provide a better form of documentation of the enforcement process which started last July.  The report will follow the outline prepared by Jack for an oral presentation.  Jack will provide a more detailed outline to the Committee.

 

Sections of the report have been assigned to each member of the Committee and will cover the need for enforcement, history of the Committee, development of AR 09-09, the details of how the enforcement procedures work, enforcement at the Community Center, the reworking of the Design Guidelines, how inspections will be conducted, and the role of the Board, the PM and the Covenants Committee in the process.

Notes for Ad Hoc Committee on Enforcement – March 22, 2010

Attendees:  Jack Mounts, Chair; Jake Bernard, Tom Whalen, Shirley Sommer, Bill Smith, Debbie Sutton, Ann Jones and Susan Manch.

1.  Implementation of Center sign-in system enforcement procedures

o  Enforcement of Center rules and regulations in the Center Community Center may begin immediately.  The process is initiated by formal submission of a violation notice from Ann to Debbie.  Then the regular enforcement process begins with a pre-violation letter being sent.

o  It was noted that the Community Center rules and regulations and FRCA declaration require showing activity cards to enter the Center. Cards are issued only to eligible residents, and the concierge monitors the continued eligibility of residents through the sign-in system.

o  Debbie will provide updates to the concierge database, including listings of new residents and those residents who are no longer at Falls Run.

o  The concierges will continue to require new tenants to provide Tenant Certification forms which are needed to prove that FR meets the government age qualification restrictions.  These forms, and the Age Affidavits forms maintained by Debbie, are needed for the computerized system of counting ages of residents and eliminating the need for a physical census every two years.

2.  The Committee approved, for forwarding to the Board, the Notice of Schedule for Requested Hearing form/letter to be used for residents requesting a hearing before the Covenants Committee.  The form was developed by Don Horan.

3.  The Committee reviewed the draft of the final report to the Board.  Some changes were made to completed sections of the report.  The sections on Inspections of Homes and Role of Board in Enforcement will be added.

4.  It was noted that AMS will incorporate into the Connect system the enforcement forms provided to the Board by the Ad Hoc Com after they have been approved by the Board.  Debbie, then, will be able to call up a form as needed, complete it and have it automatically deposited into the resident’s Connect system file.

5.  This was the final meeting of the Ad Hoc Committee on Enforcement, ending 8-month duration from July, 2009 through March 2010 or 9-month duration through the end of April.  It is anticipated that the Board will not request further activities by the committee.
