FRCA Covenant Committee Meeting Minutes of May 5, 2011

The meeting was called to order by committee chair Marv Wagner.  Members in attendance: Jack Mounts, Bill Smith, George Malhiot, Frank Kasmer, Tom Lloyd and Nancy Garner.   Toni Brown attended as FRCA BOD liaison. 

Minutes of April 7^th meeting were corrected and accepted.

Jack Mounts reviewed changes to AR10-02 Meetings of Directors and Committees.  The committee went over this AR last meeting and Jack sent committee members what he considered our final version based on this past discussion.

A heated discussion ensued between committee members regarding Covenant Committee Hearing Procedures.  All agreed 09-09 in its present form is difficult (impossible?) for most homeowners to understand.

Regarding the hearing scheduled for May 19, 2011.  Jack reminded the committee that the “Notice of Violation and Hearing Opportunity” provided to Covenant Committee by the Property Manager does not specify the sanctions that would be imposed if the committee upheld the violation noted on the form.  Prior to the hearing should sanctions be determined?  If so, who decides what the sanctions should be?

After much discussion a revision of the Preliminary Notice of Violation was approved by a vote of 6 to 1.

Because the BOD has asked the Covenant Committee to implement during the rework of AR09-09 the recommendations by the BOD’s subcommittee on delinquencies and the BOD is conducting FR property inspections during May/June, Jack asked for a status report from the subcommittee working on AR09-09.  George will write a proposal for review in its entirety for AR09-09.  Jack agreed to provide BOD and State of Virginia changes that may affect 09-09.
